SWIMMING WAVE TERMS AND CONDITIONS

DATA PROTECTION POLICY

Swimming Wave will not use or make available any personal information that we hold to any third party not directly responsible for or connected with the administration of your booking. Swimming Wave will not use your personal information except to send you promotions, mail marketing, course information and notifications. If you prefer not to be sent any correspondence from swimming wave, please contact us by email and request to unsubscribe from our mailing list, this will result in no course reminders or information of any kind being sent.

GDPR
Swimming Wave is known as the ‘Controller’ of the personal data provided to us.

Why we need your data ?

  • We need to collect your information so we can keep you informed on our future courses, discounts and competitions
  • We do not collect sensitive information such as any medical details.
  • We store your personal information carefully.

What we do with your data? 

  • We retain personal information only for as long as necessary to carry out these functions. If you notify us that you no longer wish to be listed on the database we will delete your information as soon as possible.
  • We use your data to provide information to you about our swimming lessons.
  • We may use your information to contact you about how to improve our service or market future courses.
  • We do not share your information with anyone unless we are required to do so by law.
  • We do not sell your information to anyone.
  • All the personal data we process is located on servers within the European Union.

What are your rights? 

You have a right to see the information we hold on you and/or require your data to be deleted by making a request in writing info@swimmingwave.co.uk If at any point you believe the information we process on you is incorrect you can request to have it corrected. If you wish to raise a complaint on how we have handled your personal data, you can contact us and we will investigate the matter.

You can request access to your information or ask us to delete it by contacting us.
If you are not satisfied with our response or believe we are processing your personal data not in accordance with the law you can complain to the Information Commissioner’s Office (ICO).

PAYMENT

You will be billed for the whole term prior to the lesson start date. Tuition fees must be paid in full by the due date. Swimming Wave cannot guarantee your enrollment if payment is made after the due date.

REFUNDS/CANCELLATIONS

Cancelling the course

No refunds will be given on or after the day of the first lesson unless for medical reasons.

Course cancellations must be made by emailing the following address: info@swimmingwave.co.uk

Cancelling a single lesson

We cannot guarantee a replacement lesson if a class is either cancelled or missed. Subject to availability, Swimming Wave will offer a make up session. Please note:

  • Notice must be given at least 48 hours before its scheduled start time.
  • Only one make up lesson can take place per term.
  • Cancellation of shared lessons – semi-private or group – will only occur when all parties cancel the shared lesson.
  • The make up lesson offered to replace the cancelled lesson could be taught by any Swimming Wave instructor.
  • The make up lesson of the cancelled shared lesson will be a shared lesson; the parties are not entitled to individual catch up lessons to replace the cancelled shared lesson.
  • The make up lesson must take place during the term the cancelled lesson was booked and cannot be carried forward to subsequent terms.
  • No credit will be given for cancelled lessons.
  • Regarding Home-Visit Swimming Service, there is no replacement class, credit or refund provided due to pool closures for maintenance/repairs during term lessons, including issues with water temperature.
  • Lessons in outdoors pools will be held under all weather conditions, except thunder and lightning, in which case, the instructor will cancel the lesson and the tuition fees will be fully refunded (not credited to your account).

Please note that in exceptional circumstances, Swimming Wave reserves the right to cancel lessons and courses. In such events, replacement classes will be offered or a refund will be provided.

SUPERVISION
All parents/guardians are responsible for the supervision of their children, except during the swimming lesson. They must stay throughout the duration of the lesson.

RE-BOOKING
4 weeks before the end of term you will be contacted by one of our team with information regarding the next term. If you fail to make payment 1 week before the end of term your place or child’s place will be offered to someone else unless special arrangements have been made and confirmed via email by Swimming Wave.

TEACHERS
At Swimming Wave we will do our best to ensure you have the same teacher for the entire term for continuity. However, in some rare instances for example, illness we may have to find a cover teacher. If this is the case we will ensure the cover teacher is fully informed of every student ability, medical conditions and special needs to ensure a smooth change over and maximum progress

Every teacher at Swimming Wave holds either an ASA Level 2 Certificate in teaching swimming or the STA equivalent.

PHOTO IMAGE RIGHTS
In line with the 1988 Copyright Act, Swimming Wave reserves the right to use any or all photography or video taken by us during our Swimming Wave Photoshoots for our own publicity and promotion purposes. Such images remain the sole property of Swimming Wave and your agreement to these terms releases all image rights in favour of Swimming Wave.

AMENDMENTS TO TERM & CONDITIONS AND STATUTORY RIGHTS
Swimming Wave reserves the right to amend its booking terms and conditions and associated documentation at any time. These Terms and Conditions do not affect your statutory rights.
